Acceptance of terms

This page (together with the documents referred to on it) tells you the Terms & Conditions on which you may make use of the Bulk Buy It website (the "Site"), whether as a guest or registered user, and the terms applicable to the sale and auctioning of pallets through the Site.

We may update these Terms & Conditions from time to time and will notify such changes to you by uploading them on the Site. You should review the Terms & Conditions periodically for changes.

By using the Site you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions then please refrain from using the Site.

1. About us 

The Site is operated by Bulk Listings Limited trading as Bulk Buy It ("we"). We are registered in England and Wales under company number 08807652 and with our registered office at Alans House, 51 Holton Road, Holton Heath Trading Park, Poole, BH16 6LT United Kingdom

2. Accessing our site 

Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of the Site, or the entire Site, to users who have registered with us. You will need to register with us in order to purchase or sell pallets and become a member of the Site ('Member'). Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms & Conditions

3. Intellectual property rights 

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you breach these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

We respect the intellectual property rights of others and we ask you to do the same. If you believe that any of your intellectual property rights have been infringed on the Site, please email at the address set out on the 'contact us' page to report the problem.

4. Description of Bulk Buy It  service 

Bulk Buy It provides an on-line portal through which companies of any size are able to sell pallets of goods as described and in the quantities stated on the Site. The stock is in volumes that require palletisation so will be shipped in either quarter, half or full pallet loads.

Please note that Bulk Buy It does not have possession of anything listed or sold through the Site and is not involved in the actual transaction between buyers and sellers. The contract for the sale is directly between buyer and seller. Bulk Buy It is not a traditional auctioneer.

While we may provide pricing, delivery costs, and other guidance in our Site, such guidance is solely informational and you may choose not to follow it. Bulk Buy It does not review users' listings or content. Bulk Buy It has no control over and does not guarantee the existence, quality, safety or legality of items advertised; the truth or accuracy of users’ content, listings or feedback; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

5. Payment methods 

Purchases may be paid for by Paypal or Worldpay, as applicable. All prices are in pounds sterling (£), and are payable in pounds sterling (£), plus any applicable taxes, Paypal fees and delivery costs.

6. Links 

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our Site must not be framed on any other website, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice.

The Site provides links to other websites for your information. We have no control over such sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

7. Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

8. Liability

Nothing in these terms shall limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other Members post or do.

We do not review Members' postings and are not involved in the actual transactions between Members. As most of the content on the Site comes from other Members, we do not guarantee the accuracy of postings or Member communications or the quality, safety, or legality of goods on offer.

In no event do we accept liability of any description for the listing of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.

We cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute.

If you are a business user, we are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of the Site, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Despite the previous paragraph, if you are a business user and if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Pounds Sterling.

9. Waiver 

f we fail at any time to insist upon strict performance of any of your obligations under these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

10. Severability 

If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

11. Entire agreement 

These Terms & Conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

12. Force majeure 

Where a Member is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, the date of delivery shall be postponed for the period that the circumstances continue.

13. Law and jurisdiction 

Contracts for the purchase of goods through our Site will be governed by English law. Any dispute (including non-contractual obligations) arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

14. Feedback 

General comments about the Site are welcome by email to the address set out on the 'contact us' page. Complaints about a specific Member or product must be directed to the Member concerned through the contact details provided on the order confirmation email that you receive for resolution directly with them.

Additional seller specific terms 

1 - Register on the Site

In order to become a listed seller on the Site you must, register your details using the registration box on the Site. You must provide complete and up to date contact details including a valid e-mail address. Falsifying or omitting contact information such as your name, address or telephone number when registering is not permitted. It is also not permitted to use fax or disconnected numbers as a telephone number.

2 - Choose your product category

You must choose the product category of the pallet(s) you wish to sell. You can add your pallets in one category and one sub-category.

We do not allow you to list the following: 

·Recalled goods: We strongly support the efforts of government consumer protection organizations to protect consumers against potentially hazardous goods. You should check with government authorities to ensure that the products you are selling have not been the subject of a recall. Sellers in the Republic of Ireland may wish to consult the Irish eGovernment website, Oasis for further information.

·Stolen goods: The sale of stolen property is strictly forbidden on the Site, and breaches UK, Irish and international law.

·Replica or counterfeit items: items that bear a company's official brand name or logo can be listed as long as the products were made or officially endorsed by that company. We do not allow listings for counterfeit items, fakes, replicas, or unauthorized copies. Unauthorized copies include things that are backed-up, bootlegged, duplicated, or pirated—which are all illegal.

·Severely soiled or broken goods

·Complete original and imitation firearms and firearm parts, (includes rifle butts, trigger mechanisms, screws / bolts etc which are manufactured for the sole purpose of creating a functional firearm), ammunition, explosives

·Dangerous / hazardous goods including but not limited to perfumes, aftershaves, aerosols, flammable substances, dry ice, biological substances, UN classified dangerous goods and any goods specified as such under International Air Transport Association regulations (“IATA”), the Agreement on Dangerous Goods by Road ("ADR") or International Maritime Dangerous Goods ("IMDG") regulations.

·Batteries or any products containing hazardous chemicals or acids

·Furs and ivory

·Human remains or ashes

·Live animals (including but not limited to mammals, reptiles, birds and fish), Insects, larvae, pupae etc

·Pornography (whether in printed, film or digital format)

·Tobacco, loose leaf tobacco products and pre-rolled cigarettes

3 - Enter your product details

Enter the details of the pallet contents such as product name, special conditions or warnings and selling or minimum bid price. You can add up to three pictures. You must also add a short but clear description and a few simple details of the product. Please note that we place listings on your behalf. You are solely responsible for all information that you submit to the Site and any consequences that may result from your listing.

If you are selling pallets as a trader (i.e. for business purposes), you should inform yourself of your obligations towards consumer customers under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, in particular their right to change their minds regarding a purchase within 14 days of receiving a product, and to reject faulty or misdescribed products within 30 days.

4 – Complete sale

Once an offer is made for your product by a Member, you will be notified by automated email from us and the product status will change to 'under offer' in the 'My Products' section within the 'status' category.  You have three days in which  you can accept the offer to buy. In which case click on the ‘accept’ button and an email will be sent to you with the address of the buyer.  Before accepting the offer, please ensure you have agreed payment and delivery terms with the Member buyer - you can do this through the Bulk Buy It messaging system. Bulk Buy It will collect the purchase price via its Paypal account and forward it to the account nominated in your registration form after deduction of the agreed commission and delivery charges. Once payment has been received, please notify the buyer who will then arrange for collection of the item. 

4 - List your product and pay listing fee

Once you have completed the description of your pallet(s) in the seller section, click "list". You will be asked if you want to offer your product for 'instant buy' (if available) or auction or both.

The listing fees are set out on our fees page at http://www.bulkbuyit.com/content_pages.php?page=faq and depending what you have selected, listings will last for either 1 day, 1 week or be available for instant buy. Listings must be paid for at the time the listing is placed via the Site's payment processor Worldpay. All prices exclude VAT if applicable.

5 – Complete sale

Once an offer is made for your product by a Member, you will be notified by automated email from us. You have three days in which you can accept the offer to buy. In which case click on the ‘accept’ button and an email will be sent to you with the address of the buyer. Before accepting the offer, please ensure you have agreed payment and delivery terms with the Member buyer - you can do this through the Bulk Buy It messaging system. The buyer will then submit payment to you through Paypal. Once payment has been received from the buyer, please notify the buyer who will then arrange for collection of the item.

6- Commission

Commission is payable to Bulk Buy It on all sales of pallets via the Site at the rates set out at www.bulkbuyit.com. Commission is deducted from the Member buyer's payment to you via Paypal.

7- Our involvement in the sale of pallets

The resulting legal contract for the sale of pallets is between the you and the buyer and is subject, in addition to these Terms & Conditions to the terms and conditions that you, the Member seller, advise buyers of in your description of the product or in further correspondence regarding the product. You should carefully review the specific terms. We are in no way involved in the contract for the sale of any products offered on our site.

8 – Refunds and Returns

In the event that you agree to accept a return and/or agree to refund the Member buyer for their purchase, please arrange refunds directly with the Member buyer through Paypal.

9 – Your guarantee to us

You warrant that:

·You have the right to sell the products/pallets.

·You are at least 18 years old

·If you are registering as a business entity, you have the authority to bind the entity to these Terms & Conditions.

·You will not use the contact details of any buyer to send spam or threatening e-mails

·You comply with any delivery policies that we notify you of from time to time and will not in particular list anything that breaches the intellectual property rights of a third party, is illegal or is false or misleading

Additional buyer specific terms 

1 - Register on the Site

In order to buy pallets on the Site, you must register your details using the registration box on the Site. You must provide complete and up to date contact details including a valid e-mail address. Falsifying or omitting contact information such as your name, address or telephone number when registering is not permitted. It is also not permitted to use fax or disconnected numbers as a telephone number.

2 - Shop or bid for pallets

In order to purchase or bid for pallets on the Site simply enter the amount you wish to pay and click on “place bid”. If available, you may be able to buy a pallet using the “instant buy” option. You also have the option of, first entering your postcode to determine the cost of delivery and what level of delivery service you wish to opt for. Once you find a pallet or pallets you like, click on item description to view the specific contents of the pallet. You will be able to ask the seller any questions you may have before you decide to buy or bid for it, e.g. payment and delivery terms, further product details etc. through the Bulk Buy It messaging system. Payments may be made in Sterling or, if available, in Euros to the seller through Paypal and will be subject to Paypal’s conversion rates and charges in force at the date of payment.

You should look out for and not purchase the following:

·Recalled goods; you are responsible for checking if any goods have been recalled products in the areas that you might be bidding. As a first step, you may wish to consult the site of the UK Trading Standards Office.

·Stolen goods: The sale of stolen property is strictly forbidden on the Site, and breaches UK, Irish and international law.

·Replica or counterfeit items: items that bear a company's official brand name or logo can be listed as long as the products were made or officially endorsed by that company. 3 - Confirm your purchase or bidding process

Instant Buy: If available, in order to confirm your purchase, select the 'Instant Buy' button under the product. An email will be sent to the seller telling them you have made an offer to purchase the goods specified within it.

Auction process: In order to bid for a pallet, insert the amount you wish to bid for. This will be recorded on the site until the advertised time for bidding for that particular item closes. If yours is the highest bid, you will have been successful in your purchase and will be obliged to complete your purchase.

PLEASE NOTE:

·You are responsible for reading the full pallet content listing before making a bid or commitment to buy.

·You enter into a legally binding contract to purchase a pallet or pallets when you commit to buy an item, or if you have the winning bid (or your bid is otherwise accepted).

 

All offers are subject to these Terms & Conditions and any additional terms and conditions notified to you by the Member. While you are waiting for the auction process to be completed, your chosen pallet(s) will be displayed in your account under the 'My Bids' section with a status of under auction' written in the status category. Click on 'view' to see the details of the bids you have made.

4 - Complete your purchase

No bid shall be deemed to be accepted by the Member until an email is issued to you by the Site acknowledging your bid has been successful. The contract will relate only to those pallets notified in the email acknowledgement of order. Once the seller accepts your offer, the product status will change to 'Sold' in the 'My Bids' section. You should then select your preferred method of delivery (see below) and will have three days to make your payment for the pallet(s) to the Member seller via Paypal.

5 – Our involvement in the sale of pallets

Please note that we act as a neutral site through which Members can buy and sell items and we are in no way involved in the contract for the sale of any items offered on our site. The resulting legal contract is between you (the Member buyer) and the Member seller, and is subject, in addition to these Terms & Conditions, to the terms and conditions of the Member seller, which they will advise you of in their description of the product or in further correspondence regarding the product. You should carefully review their specific terms.

We cannot give any undertaking, that goods you purchase from Members through the Site will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. Where you order goods through the Site we will disclose your customer information relating to the transaction to the relevant Member. We do not review or control, and are not responsible in any way for, listings provided by Members and at no time do we possess any items offered for sale through the Site.

6 – Delivery

Once your bid has been successful, you will be offered the choice of shipping options, either economy or premium. You can choose to use the haulier suggested on our Site or arrange collection yourself. The prices for delivery by the haulier suggested are displayed on our Site here . Prices exclude VAT where applicable. Payments for such deliveries are payable via Worldpay.

All deliveries arranged with our suggested haulier are subject to the terms of the haulier which are available here. Please note that we accept orders and payments on behalf of the haulier but we are in no way involved in the transaction between you and the haulier. The resulting legal contract is between you (the Member buyer) and the haulier.

7 – Returns

If you wish to discuss or organise a return, exchange or refund of any item, please contact the Member directly using the contact facility on the Site.

8 - Import regulations and duty

If you order pallets from our Site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that products offered for sale by Member sellers are mainly directed at UK residents. Bulk Buy It and its Members make no representation that any products sold through this website are appropriate or available for use outside of the UK. You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

9 - Your warranties to us

You warrant that:

·You are at least 18 years old

·If you are registering as a business entity, you have the authority to bind the entity to these Terms & Conditions

·You will not use the contact details of any seller to send spam or threatening e-mails.
